NEW York State law regarding Public Access Defibrillation is outlined below. Cardiac Life Products
provides a range of services to assist with the implementation of these laws.
Public Access Defibrillation in NYS
- “A Public Access Defibrillation (PAD) program is designed to encourage greater acquisition,
deployment and use of automatic external defibrillators (AED) in communities around the state
in an effort to reduce the numbers of deaths associated with sudden cardiac arrest.”

- “Public access'' to AEDs does not mean that any member of the public who witnesses an event
should be able to use an AED. “Public access'' refers to the accessibility of the device itself.
- New York State is vigilant in its efforts to ensure AEDs are available in the event of an emergency.
Below is an overview of organizations that are currently required to have AEDS. The list is subject to
change as new legislation is enacted.
- New York State Policy for your Public Access Defibrillation (PAD) Program includes a Notice of Intent (NOI),
Collaborative Agreement(CA) and Medical Direction (MD) :The purpose of this
policy is to assist a person, firm, organization or other entity in understanding the notification process
for operating an automated external defibrillator pursuant to a collaborative agreement under the provisions
of Chapter 552 of the Laws of 1998 authorizing Public Access Defibrillation. A Public Access Defibrillation
(PAD) program is designed to encourage greater acquisition, deployment and use of automatic external defibrillators
(AED) in communities around the state in an effort to reduce the numbers of deaths associated with sudden cardiac
arrest. Since the enabling legislation’s inception, there have been 4,140 PAD programs established, with over
135,000 people trained. To be authorized to use an AED under this statute an individual or organization needs to
make specific notification of intent to establish a PAD program to the appropriate Regional Emergency Medical
Services Council (REMSCO) and the New York State Department of Health (DOH).There are no approvals or certifications
required by law in NYS.

Entities Required to be PAD Sites
The following entities are required to be a PAD site
- Public Schools: In 2003, all public school districts & charter schools became mandated by NYS Education
Law to provide AEDs. This must be done in accordance with the PAD Program.
- Health Clubs: NYS General Business Law requires that any health club with a membership of 500 or more
provide AEDs at their locations in accordance with the PAD program.
- Public Buildings: In 2005, NYS Public Buildings Law was amended to require public institutions and buildings
of the state to equip each public building with an AED. This must be done in accordance with the PAD program.
- Places of Public Assembly: In 2006, a law was enacted requiring an AED in certain places of public assembly.
It affects places with an occupancy capacity of at least 1,000 people (i.e. theaters, stadiums, ballparks,
gymnasiums, field houses, arenas, civic centers, concert halls, recital halls, indoor and outdoor amphitheaters
or other auditoriums used for the presentation of musical renditions or concerts). It requires that at least
one employee be present at all times who is able to operate an AED.
- Public Surf Beaches with Lifeguards: In 2008, Public Health Law was amended to require public surf beaches
requiring life guards to also be equipped with AEDs in accordance with the PAD program.
- Local Municipal Requirements: Some municipalities have enacted additional requirements for certain organizations
or locations. For instance, in Westchester County, the Town of Greenburgh requires all nursing home and adult
care facilities to have AEDs on their premises. In the County of Suffolk, all health clubs, regardless of size,
are required to have AEDs at their facilities. It is advised that organizations that service a specialty group
category, e.g., recreation/sports, elder care, special needs populations, etc., should contact their local
municipality to ensure that additional requirements are not enforced in your area.

PAD Requirements
To be authorized to have a PAD program and utilize an AED, the following steps must be completed:
- Identify a New York State licensed physician or New York State based hospital knowledgeable and
experienced in emergency cardiac care to serve as Emergency Health Care Provider (EHCP) to participate
in a collaborative agreement.
- Select an AED that is in compliance with the Article 30, section 3000-B (1)(A). The AED must be programmed
to the current Emergency Cardiovascular Care (ECC) Guidelines, capable of defibrillating both adult and
pediatric patients.
- Select and use a Dept. Of Health approved PAD training course for AED users.
- Develop with the EHCP, a written collaborative agreement which shall include, but not be limited to the following items:
protocols for AED use and maintenance, procedures for notification of EMS by calling 911, procedures for incident
documentation.
- In July 2007, 3000-b of the New York State Public Health Law, Section 1 - Subdivision 3, was amended by adding paragraph
requiring a sign or notice to be posted at the main entrance of a facility or building in which the AED is stored or
maintained on a regular basis. It is expected that the size, type and language(s) of the sign will be easily legible
upon entrance to the structure. If there are multiple entrances that could be considered a main entrance then a sign
or notice must be placed at each of those entrances as well.

Equipment
AED unit: Select an AED that is in compliance with the Article 30, section 3000-B (1)(A). The AED must be programmed to the
current Emergency Cardiovascular Care (ECC) Guidelines, capable of defibrillating both adult and
pediatric patients
Signage: In July 2007, 3000-b of the New York State Public Health Law, Section 1 - Subdivision 3, was amended by adding paragraph
requiring a sign or notice to be posted at the main entrance of a facility or building in which the AED is stored or
maintained on a regular basis.

Proper CPR/AED training is key to the success of the AED program. Often, the focus is on the equipment while training is
haphazard. Cardiac Life Products is an Authorized American Heart Association Training Center. We can provide a wide array of
course offerings which include onsite training and blended classes. Our team of experienced instructors have first-hand
knowledge of Emergency Medical Services. Our instructors include individuals that have achieved the highest levels of

Medical Direction
When you purchasing Medical Direction, Cardiac Life Products will provide the following services:
- A completed Notice of Intent and Collaborative Agreement. The customer will sign the agreement, and Cardiac Life Products
will file the paperwork.
- The first year you purchase medical direction, the agreement will detail all the requirements your organization must maintain.
- Cardiac Life Products will notify you if changes need to be made to the paperwork.
- Templates for Responder information, defibrillator information, maintenance check list, emergency response plan,
and post event report.

Program Management
Cardiac Life also offers a program management option that can include the following:
- Installation of a new unit.
